Frequently asked questions

Legal FAQs for Delhi.
Plain answers to common questions.

General answers to common questions on choosing an advocate, family law, criminal law, POSH and civil matters in Delhi. This is information only, not legal advice.

How do I choose a good lawyer in Delhi?

  1. Check enrolment. Every practising advocate must be enrolled with a State Bar Council; in Delhi, the Bar Council of Delhi. Ask for the enrolment number.
  2. Match the experience to your case. Family, criminal, civil, corporate and POSH matters each have their own procedure and courts.
  3. Ask where they appear. Delhi has separate district courts, a High Court and consumer and tribunal benches.
  4. Get scope and fees in writing before engaging, and ask how updates will be given.
  5. Be wary of guarantees. No honest lawyer can promise the result of a case, and advocates are barred from soliciting work.
  6. Look for clear communication – you should understand the options, risks and next steps.

Family law

What is the difference between mutual consent and contested divorce?

In mutual consent divorce (Section 13B, Hindu Marriage Act), both spouses agree to end the marriage and settle terms. In a contested divorce, one spouse files on a legal ground, such as cruelty or desertion, and must prove it.

Can a wife claim maintenance in Delhi?

Yes. A wife can seek maintenance under the Hindu Marriage Act, the Domestic Violence Act and Section 144 BNSS, depending on the circumstances.

Criminal law

What should I do if the police call me for questioning?

Remain calm and cooperative, ask for the notice in writing, and consult a lawyer. In suitable cases the notice procedure under the BNSS protects against automatic arrest.

What is the difference between bail and anticipatory bail?

Bail is sought after arrest; anticipatory bail is sought before arrest, when one fears arrest in a non-bailable offence.

POSH

Which workplaces need an Internal Committee?

Any workplace with 10 or more employees must have an Internal Committee. See POSH lawyer in Delhi for details.

Civil and property

How do I recover money that someone owes me?

Usually by a legal notice first, then a recovery suit or a summary suit, depending on the documents. Cheques that bounce can also lead to a Section 138 complaint. See civil lawyer and criminal lawyer.
