Trademarks and intellectual property

Brand names and logos can be protected by registering a trademark under the Trade Marks Act, 1999. Support includes search and availability checks, application filing, responses to examination reports, oppositions and cease-and-desist notices. Related work includes copyright, licensing and confidentiality terms in contracts.

Corporate retainers

A legal retainer gives a business a single point of contact for ongoing questions: contract review, notices, HR and compliance queries, and day-to-day documents. The scope, response time and fees are set out in a written engagement, tailored to the size of the business.

Forums

Commercial Courts and the Delhi High Court, the National Company Law Tribunal benches at New Delhi, labour courts and tribunals, consumer commissions and arbitral tribunals, depending on the matter and its value.

General information only; it is not legal advice. Scope is confirmed for each engagement.

Frequently asked questions

Does a startup need a lawyer on retainer?

It depends on the stage. Early-stage companies often need help with incorporation, founders’ agreements, employment contracts and trademarks. A retainer is useful once there is regular contract and compliance work.

What is the difference between a private limited company and an LLP?

A private limited company is governed by the Companies Act, 2013 and can raise equity funding; an LLP is governed by the LLP Act, 2008, with more flexible internal management. Tax, compliance and funding plans guide the choice.

Can you help with a trademark registration in Delhi?

Himani assists with trademark searches, applications and responses to objections and oppositions under the Trade Marks Act, 1999.

Is a POSH policy required for companies?

Employers with 10 or more employees at a workplace must constitute an Internal Committee under the POSH Act and follow the employer duties in Section 19. See the POSH page.

Where are commercial disputes heard in Delhi?

Commercial suits are heard by Commercial Courts at the district level and, above ₹3 crore, by the Delhi High Court. Many contracts provide for arbitration instead.
